No Disclosure

Had a new one yesterday! Very elderly lady but sharp, selling her double wide and moving to Ohio to be near family. I took seller documents to her for signing. There was no disclosure, HUD info, inspection, etc. Not my place…she had made the comment that she was tired of all “the signing”. She brought her nephew with her to sign this package They had her so confused she wanted him to look over everything. A lot of conversation into Disclosure of funds for the sale. Referred him to the title company his aunt had been working with. They didn’t have a disclosure and didn’t know how much she would get!! They actually stated it had not been generated. (If anyone believes that…). NOW he was told this was not the actual closing; that would be scheduled for later. (She’s moving to Ohio this weekend). Of course I couldn’t offer any legal advice I could only explain the documents I was presenting. We got to the Deed…I explained what the document was and all the bells and whistles went off for them. I sincerely believe that whomever they were dealing with tried to create a mortgage fraud. To the new notary’s, know your package checklist; buyer and seller. Know what goes to the courthouse out of each package to process the sale and record the title. You can’t give advice but it might stir their curiosity if things don’t add up. Presentation and knowing the documents is the valuable resource for clients who have only talked to a “voice” on the other end of the phone.
Final note: they signed all the other paperwork and yes, I’m getting paid. An actual closing for Deed to be signed will have to occur in Ohio.

Sometimes a buyer hasn’t signed their paperwork yet which causes a delay in being able to generate final numbers and a CD.

It’s important that notaries stay in their own lanes. We shouldn’t have feelings about someone’s dealings. Bottom line is you don’t know and shouldn’t be encouraged to guess.
