Attorney in Fact question

This is for the Deed of Trust (Acknowledgement) for the state of Calif. Do I need to circle “are, they, their” or treat this as one person which “is, he, his,”

On Oct 4, 2021 before me,

(Nick, Notary Public),

personally appeared, John Doe and Jane Doe by John Doe, Attorney-In-Fact
who proved to me on the basis of
satisfactory evidence to be the person(s) whose name(s) is/are
subscribed to the within instrument and acknowledged to me that
he/she/they executed the same in his/her/their authorized
capacity(ies), and that by his/her/their signature(s) on the
instrument the person(s), or the entity upon behalf of which the
person(s) acted, executed the instrument.

One person. Only the person who appeared before you.

And your cert cannot state any capacity…only John Doe

That is what I figured. So I just circle the one person (is/his). Do I need to cross out “Jane Doe by John Doe, Attorney-In-Fact” or leave it as is? This document is provided by the escrow company.

You in CA can’t represent capacity…so either cross it out and initial, attach your own CA compliant cert or have title send you new docs.

Check your handbook about acknowledgements…you are not allowed to represent capacity in your certs.

Thanks for the confirmation. Weird is that the agency told me to leave it as is. They have been getting a few rejections without the “Jane Doe by John Doe, Attorney-In-Fact” wording.
