Why would u charge someone before they get to your office or you have actually notarized anything, just wondering

I know you updated this to explain it was GNW. But I’d like to point out that some mistakes are not a critical error. Title might overlook. Or they may correct it with DocuSign or some other method. Or they may contact you to go back out and get it fixed. It varies with how critical the error.

Several years ago I received a call from title that I had missed placing my stamp on the mortgage. I checked my scanback and, sure enough, the stamp was not there. BTW, if I have time, I usually scan every package before returning even if scanbacks are not required. I can use that to research any errors that are called out. After a week or so, I delete the scanned docs.

I assured title that the notary stamp was optional in Kentucky. I told them to proceed with recording and, if it was rejected for a missing stamp, I would correct it at that time. Sure enough I never heard back.

P.S. There have been changes in Kentucky regulations since that time. So, if the same thing happened today, it probably would not be accepted. Stamps are still optional as long as the notary has included their expiration date and commission number. I’m not sure that exception applies to mortgages, however, and I haven’t taken the time to verify. I just always use my stamp so it’s not an issue.

I said nothing about drafting a document. I think you must have replied to the wrong thread.

Mistakes happen. Never feel rushed or pressured. Just let the client know you wanted to make sure the document is completed correctly. Why did you draft a document for a client? In Texas it’s prohibited. I’m not sure about other states.

I have never been so overjoyed to have a redo. Sucks for them, but to this day, they haven’t bothered to pay me.

The guy did go to jail that day. I haven’t been paid, and I told the wife to find a notary and see if they will take it to the jail.

I have washed my hands of this. Big lesson learned. Wife waited two months to contact me. It can’t be that important.

He gets out next month. Hopefully he leaves me alone.

Next time, don’t leave home until receipt of payment arrives from Square if that’s your agreement. Too bad the guy showed up at your office - you had no obligation to meet with him - he did not follow directions to pay in advance & wait an hour so you could coordinate a time to meet with him. Whenever you have the sense that someone doesn’t want to pay - require payment by Zelle - it’s irreversible & not subject to chargebacks like debit/credit cards. In my operation, for the average customer, paying by card is fine. For certain requests or unique situations, (especially Apostille services) paying by cash or Zelle is required. People that don’t follow your agreement, require Zelle payment.

Some charge in advance as a non refundable deposit for their appointment. If they miss their appointment and you show up, you still got paid for your time. In CA, we can charge travel plus $15 per document. I would like to make my deposit $15, so that at least it covers the document fee.
