Notarizing for a Family Member-Texas

Goid morning. My husbad has given his sister a truck and she has to have an affidavit notarized. There will not be a monetary exchange and I will not benefit in anyway. Is it okay for me to notarize the affidavit?

Although I’m not in TX (FL), what does the notary law in TX state? Here in FL I have the following: (11) A notary public may not notarize a signature on a document if the person whose signature is to be notarized is the spouse, son, daughter, mother, or father of the notary public. Appears to be a little gray in this case but personally, I would not do it.

The basic rules are: the act of taking and certifying acknowledgments cannot be performed by a notary public financially or beneficially interested in the transaction; and one who is a party to an instrument, cannot act as a notary public. There is no specific prohibition against a notary public notarizing another spouse’s signature or a notary public notarizing for a spouse’s business. The facts in each situation will determine whether such action is proper."
