Do notary’s sign this or should I write on that statement: “This is an illegal or inappropriate use of a seal in [the Notary’s state],” and initial the note without signing or affixing a seal.
The statement you intend to use may be construed as a “legal” opinion and thus, outside of your purview as a notary. When I get such documents, I just attach a sticky note (or sometimes write on the document) indicating that my notary commission does not allow me to affix my seal/stamp. I fill out what I can and sign it as “signing agent” and DON’T use the title “Notary” so as to ensure that there is no question about it having been notarized.
