Ohio notaries — Application for Dealer Assignment

Any Ohio notaries come across this form? Who can notarize it? It is an application for dealer assignment. Does the person giving attorney in fact rights need to be physically present for the notarization? I would think so. However the below title does say deputy clerk notary. In OH are notaries also deputy clerks?

I had the signer in my physical presence for the signature however was told not to notarize and in OH the deputy clerk will notarize this form. Also the signer that was physically present with me will not go to Ohio to be physically present there in front of the deputy clerk notary. Maybe I’m missing something here, I’m still doing some digging on this.

In any case dealers do not always do things correct and take on huge liabilities (their notaries do too and might not even know it). My husband purchased a vehicle 3 hours away and they sent him all the papers to sign and overnight which he did than the dealer’s notary, notarized it all without him there!!! Including a POA!!! This is no mom and pop dealership either. The vehicle was driven to him after the papers finalized. Usually a dealer will need to work with a notary nearby for this type of signing but it does not seem to be the case.

Back to my question, I’d appreciate more information on this Ohio Application for Dealer Assignment, especially if someone is better familiar with Ohio notary rules.

Not sure what part of this your contracting party isn’t understanding.

And to answer your question, yes, in many states the clerk or deputy clerk of the court can notarize - the words under that signature line are denoting “clerk OR deputy clerk OR notary”

Either way - it needs to notarized, and not by an Ohio deputy clerk while your signer is in WA…

Hindsight is 20/20 here - and the question comes to mind - if they wanted to work it this way (sign and send back) why bother you? Just send it to the guy and tell HIM “please sign and return”.

Thanks Linda yeah that’s what I was thinking too. They said the deputy clerk always notarized these for them without the signer needing to be there and to leave it blank.

Exactly, but I have done signature only appointments for vehicles before, collect original title or checks.

In this one particular I did notarize and out of state tax form.

The only thing I do regret here, I could have included my own loose jurat certificate attached “in case” even tho I called and they told me not to notarize this that it is the deputy clerk notary that will do so.
