Collection Referral

After numerous attempts to collect money from a signing service for a signing I completed at the end of November 2025. I am considering the possibility of sending a DEMAND FOR PAYMENT/Notice of Pending Collection Referral via “Certified Mail to a named company with Restricted Delivery to a named individual, and a return receipt.”

The contract stated “LLC will issue checks twice monthly, on the 1st and 15th. No Notary will wait longer than 30 days for payment.”

I contacted the title company without mentioning any payment issues and was informed that the documents were error free and they were very satisfied.

I will no longer be working with the company in question, but I am wondering if it is inappropriate to refer them to collection agency. What counter measures could they take to harm my reputation?

Any thoughts or suggestions would be much appreciated.

No it’s not inappropriate and I would send one (and copy title on it). To prevent any harm to your reputation, just keep the letter factual to the issue at hand, don’t take personal shots at anyone - keep it business and professional.

Also, even though title said they were happy with it - I would check the property records/recorded documents and find the mortgage you notarized - that’s your proof that the loan you had signed did, in fact, fund.

Very slow around here because of all the snow so I think I will take your advice and check to see that it did in fact fund.

Who is the signing service in question? Naming them in forum may save your fellow NSAs from accepting any assignments from them and then not getting paid.

I totally understand and appreciate the suggestion. That said, I keep a lawyer on retainer, and he’s made it very clear that I should never provide names on a public forum—even when I’m only stating the facts. He mostly keeps me in check, because left to my own devices I’d probably take out a full-page ad in their local paper and end up with a defamation suit.

It’s good advice because perfectly good signing services might think a notary who blasts services online will blast them too and not want to bother. I also want to mention that some SS on signingorder say the 1st and the 15th but indicate with first payment there can be a delay. You may want to check that on their terms of service. If through a platform those TOS should be accessible.

Following a review of the county records, the Mortgage and Deed have been filed, and Title has confirmed payment. I will proceed by sending Certified Mail to the named registered agent to determine whether I receive a response.

I appreciate everyone’s input and will provide updates should there be any positive developments.

Try letting Title know you haven’t been paid. They often will ‘remind’ SS (as non-payment reflects on them, too, and SS doesn’t want to lose their business).

Update:

I sent a Certified Mail with Restricted Delivery to a specific individual (so only that person can sign) along with a return receipt. Today, tracking shows it was delivered—but to the front desk, not the intended recipient who’s supposed to sign.

From what I can tell, USPS considers it delivered. I’m waiting for the return receipt before filing a Missing or Misdelivered Mail complaint. Hoping USPS can clarify the rules for Restricted Delivery.

At first, I was a bit frustrated—but then I thought, even this Great NSA has its flaws! :joy:
