I had a signing done 2 days ago and today i got an email saying i missed a acknowledgment that needs to be notarized
and they want me to keep the same date on it the signing happened they want me to Notarize an acknowledgment and keep the dates 10/5/2020 what should i do? can i attach another acknowledgement with it stating the date or what im lost
Hmmm
Youāre not supposed to, legally, and that is a conflict. Same thing happened to me about a month ago, my first error, and I had a back and forth with the lender and the SS⦠at the end I told them not to pay me and send some else, but they insisted⦠I just did it to get them off on top of me. What frustrated more the situation is the low pay for a refinance that what supposed to be 1/2 of the pages because supposedly most of the packet was done online⦠it was a lie
Is up to you to do it or not with different date
What I usually do is to post it flag every single signature where signer(s) sign(s)⦠I know most of the time signers try to start conversations and ask questions that doesnāt let you focus 100% on the signing. You canāt let that happen!!! Politely tell them that you need every single signature to be error free, if not youāll have to be back to them or the loan might delay. When they hear the loan might delay, they just smile and shut their mouth for a while
⦠also, double check every page before you leave their house.
Knowing where you are is critical;
First of all, Iād ask them to send a copy of the document where the acknowledgement was missed. Then, depending on your laws, you may have to go back to signers and have them re-acknowledge their signatures (like here in FL). But that said, never never never do you backdate - your new ack must contain the current date - stick to your guns about this and do not let them bully you into breaking the law.
Now, if youāre talking about that All Purpose Acknowledgement that some companies include in the package that is not attached to anything, but they want you to sign an stamp it ājust in caseā - the answer is no - I send those back unsigned - canāt sign and stamp an ack that is not associated with a document.
Some companies will do anything to get the loans through - donāt let them bully you into anything you shouldnāt do.
Good luck
Thatās what they made me sign and stamp⦠an ALL PURPOSE ACKNOWLEDGMENT

That is ridiculous!
Loose all by itself with no document attached?? HUGE No-No - never ever do that
It was supposed to be attached to a deed that my printer chopped their bar code number⦠huge chaos! After that I put that lender in my NO-NO list!!! they were very cheap, and told me that it was 1/2 of a refinance packet; it was a lie. They put so much pressure, that at the end I felt the were bullying me
Did they show you the chopped up one? IMO if this happened and they contacted you, ask for the document back, go back to the signers, re-acknowledge and re-notarize (with current date). Never provide a loose APA for them to attach to whatever suits their fancy.
I forget where youāre located, but thatās what FL law wants US to do - no corrections to notarizations once it leaves our handsā¦it becomes a whole new transaction.
Itās been over a month already⦠but believe me, Linda, I wonāt let lenders and SS to put me in that position ever again! After a thought of everything that happened I felt like I did something wrong. By the way Iām from New Jersey
Okayā¦but donāt be surprised if I forget and ask again!! LOL! Itās a way of life for me⦠![]()
LMAO
Thank you for all your help and guidance!
Awesome information! It is always best to use best practices. Thank you both LindaH & zabdul for sharing the response and the post.
If i went to the signing on the 10th and witnessed the borrower signing and dated the 10th. I get a call on the 12th that I didnt put my stamp on the doc. They send me the original they wouldnt resign again but I witness it on the 10th I just have to stamp it. If I have to go back out and have them resign I agree it has to be the date you witnessed the signature
fourrr - I donāt know where youāre located, but if youāre saying you just get the doc back and stamp it and send back - that may be all well and good in your state - but here in FL (and in CA and some other states) that is against notary law - in your scenario another visit is required and a reacknowledgement is required with the current, later date.
In Florida you canāt do that. I confirmed with National Notary Association (NNA). A non specific acknowledgement can be attached to ANYTHING! I send them back unsigned with a Post-It note saying illegal in my state.
Remember, as a notary, you are bound by your honor. If you sidestep that for whatever reason, you have nothing and will not be of a character required to hold the public office of Notary. No one may ever find out, but you will know.
