Providing a Witness

Has anyone had to provide witnesses for a signing at a person’s home? There is a document within the refinance which requires two witnesses and the signing company is asking me to provide witnesses…

Where are you located? Do your laws allow you to be one witness?

It is not up to you do provide them; that’s up to the signers - usually they can get a neighbor or two to come over and be witnesses. I just let the signers know that the witnesses don’t need to know their business - they just need to watch them sign that one document. If YOU need to provide the witness(es) then you should let title know there is an additional fee for that as the witnesses need to be paid for their time (for me, that’s usually an extra $25-$35 per witness).

But no - it’s not up to YOU - it’s up to the signers to arrange that.

I’m located in Las Vegas and that is the answer I was looking for! I will check here in Nevada if they allow a notary to be a witness. Thanks for the response, LindaH!

I do not provide witnesses unless it is specifically requested ahead of time, prior to the signing. If so I will ask for an additional fee for each witness.
Generally speaking it is not the responsibility of the notary to supply witnesses.
I recently had a signing assigned to me for a deed in lieu from BNN. Nothing was stated in the assignment ( or on snapdocs) that 2 witnesses would be required to be present. After the signing I scanned all docs back to BNN as instructed. I was informed that I would have to provide 2 witnesses and go back out to have the POA resigned. I informed BNN that it is not my responsibility and that either the title company, their rep, or the signing agency touch base with the client to provide witnesses.

Here in Mass, I do a ton of FLA properties. FLA requires witnesses and yes the Notary can be a witness in all states except Alabama! I have a cheat in my briefcase that covers ink/witness requirements for every state. PM me for a copy.

Also, I will arrange for a witness. I charge between $25 -$75 for witness. If the signing is an hour, its higher! Best of luck to everyone! And lets keep trading info! -Adam
