Each business owner is best served by vetting their potential new client PRIOR to accepting a Signing Order (SO) from a potential client & definitively prior to providing professional services.

Always take the time to Research the Notary Cafe database for any possible threads providing the payment history with other Signing Agents (SAs).

I was in contact with the title agency. The escrow officer said I was on my own to try and collect since the hiring agency was paid the following day - after documents were recorded.

BBN does not reply to emails or answer calls. So, I went ahead and filed a complaint with the BBB. I highly suggest other notaries refrain from accepting assignments from this company. Let my lesson learned help avoid others from non-payment.

LENGTHY- BUT PLEASE READ and give me your advice.

I received an order from them last week for this coming MONDAY. This was on my order:
Our Payment Policy

Compensation.

a. In consideration of your performance of the Services as provided herein, Brothers Bilingual Notaries, LLC agrees to pay you the amount specified and arranged at the time of accepting the order from Brothers Bilingual Notaries, LLC.
b. If a particular signing requires you to make more than one trip, you will be paid per trip; however, any additional trips MUST be authorized by a Brothers Bilingual Notaries, LLC representative, or you will not be compensated for such additional trip.
c. If mistakes are made on any document and it costs Brothers Bilingual Notaries, LLC or any of Brothers Bilingual Notaries, LLC clients time and fees to correct, Brothers Bilingual Notaries, LLC may deduct full fees or/and cost of time from your fee. If corrections to any document that you are responsible for are required it is your responsibility to have the corrections made at no additional cost. If required it will be your responsibility to return all original documents at your expense. If you are unable to pay for returned documents Brothers Bilingual Notaries, LLC may deduct the full amount of shipping costs from your fee.
d. Under no circumstances should notary contact title company, escrow officer, lenders, realtors or signers to collect payment. It is strictly prohibited. If notary does contact any party other than BBN for payments, notary forfeits compensation and will be blacklisted and removed from doing signings for BBN and other partnership companies.
c. Brothers Bilingual Notaries, LLC operates on NET60. Payment shall be made within 60 days of completion of performed Services.

I responded with the following:
Thank you for your interest in my notary services. I’d like to clarify my payment terms and policies:

  1. Payment terms: I agree with your payment terms of a NET 60 basis for notary work compensation.
  2. Late payment policy:
  • A $25 late fee will be applied if payment is not received within 15 days after the NET 60 period (i.e., 75 days from the date of service).
  • If payment remains outstanding 60 days past the due date, I will consider this a breach of contract.
  1. Collection process: In the event of a breach, I will initiate collection procedures, which may include contacting relevant parties such as the title company, lender, and other entities involved in the signing process.

I appreciate your understanding of these terms. I look forward to a productive working relationship and am committed to providing excellent notary services.

I got no reply. Then I researched them on this platform. Thank you to everyone that contributes. It helps others to avoid these types of situations. This will now be my new policy that the NEW companies have to sign in order to work with ME!
Remember- These signing companies can’t do their work WITHOUT US! WE are more valuable than they give us credit for!

Now Louis just called me and said he spoke to his manager and agreed to pay the full amount as soon as the documents have been scanned and uploaded. I can wait to ship until after my payment has been made. This is a cash transaction. My concern is that the title company can complete the transaction with my scans and they may not need the originals. Should I take a chance?
NOTE: He also said that everyone on this platform was paid and that they cannot ask that the review be taken down.

Also----I have the documents and on the settlement statement it shows that a LUX MOBILE NOTARY is being paid $150- they offered me $95

NO!! I’d RUN the other way immediately with those types of DEMANDS from them especially considering ALL the posts & threads on the Notary Cafe forum about their NON-PAYMENT history.

    • Payment is due & payable at the time professional services are rendered.
    • Once approved as a vetted client, payment arrangements can be discussed on individual request. Upon approval, negotiated payment terms can be up to (and no more than) 25 calendar days from the date of the signing appointment.
    • NO FEE REDUCTIONS are permitted without prior approval.
    • The professional services provided are as a non-party to the transaction. As such, payment cannot be withheld as it could infer the notary has a vested interest in the transaction.
    • Failure to pay within the specified timeframe will result in a breach of contract and a $25 late fee will be assessed.
    • This late fee will be assessed every 30 days until full payment is received.
    • Other parties involved in the transaction will also be contacted. i.e., title companies, loan companies, realtors and brokers, etc.

So my new strategy worked perfectly. I contacted them and let them know that since I had never worked with them before I would need payment upfront. They sent it immediately once I uploaded the scans. I did reach out to the title company before I left for this appointment because the notary business being paid in the settlement statement was not the notary company that hired me. I called them just to make sure that everything was on the up and up. I did inform them that I was cautious about working with this company since they have an f rating with BBB and horrible reviews on these notary forums with a bad reputation for not paying their notary signing agents.
