Changing Fee after signing completed

I recently did a signing for CRESclosers out of NC. When he contracted me, he was fully aware of my fees and agreed to them. After the signing was completed, they reduced the fee by $25 stating scans were not required so they reduced the fee. On the order, it fully stated the fee for $125 with no scans required. When is it appropriate for someone to reduce a fee even though fees were agreed upon and then states they reduced the fee due to scans not necessary? He agreed to my fee in writing, he should pay me the full fee. He paid me $100, then told me title reduced his fee. I received an invoice from the title company that they paid CRESclosers and they paid him the entire fee. Am I wrong for demanding the balance of my agreed upon fee? I will never accept any signings from CRESclosers because he is a fraud and steals from those of us who do the work. Help me understand if I am being petty.

NO, it is never appropriate to change the terms of the signing once agreed upon. That order they sent you is the contract. That guy owes you the full amount agreed to. If title reduced his fee as he says, tell him tough bananas – that is between him and title. YOUR CONTRACT SAYS $125, you are owed the full amount. Period.

I am in contact with Title. They paid him in full the full amount. They sent me his invoice and paid check copies. They, of course are not going to pay me, but I have the evidence I need to file a complaint with the NC Sec of State for breach of contract and theft of services. I gave him until Friday, the 26th to pay the balance or I will contact the Sec of State.

I agree. I told him my fees are my fees, he agreed to them, he owes me the money

I can’t believe these people can be so petty over $25. If I were him, I would send you the $25 and be done with it.

Honestly, I am so mad, it’s not even about the money anymore, it’s the principle about how he did this! I am very angry!

If they sent a confirmation at $125 that’s what they should pay.

When you quote do you quote scan as a separate line item? I never send a counter offer specifying what it includes unless it’s a long drive and then I just say excessive mileage and drive time. Unfortunately almost everything has scan required. And if it’s not required - I’m not offering a discount So I don’t bill it seperately.

Never do I itemize quotes. It includes everything for the signing. He agreed to my fee and the SO order even said the fee that he agreed to and it stated NO SCANS REQUIRED. He just wanted more than half the fee. He charged title $250 and then decided he should keep the extra $25 so he reduced the fee saying no scans were required so he kept the money! He is a thief of services and I will contact the Sec of State for NC and file complaint

I would just go back to him and state that he agreed to $125 and you won’t consider it paid in full unless you get the $125 and you’d like resolution without an escalation.

I never look at what is being charged for notary services. We can’t tell what that fee charged includes. JMO.

I tried to. He has lied several times saying it was title who reduced the fee, then he said he had to due to no scans required. …blah, blah. Title sent me the invoice and emails quoting tge $250 fee. He got paid $250. He is a thief.

I just sent a complaint to the Atty General for payment due, not this company though, maybe try the Atty General in the state the signing company is in. Good luck
