Just looking for your “take” on this situation…not giving mine. Keep in mind, this is not a RON state, however clients are starting to digitally sign the non-notarized loan documents. A CD is not notarized but is the nuts and bolts of the entire loan. What do you think of digitally signing a CD?

You touch on a point about the electronic portion of these new signings. Signing companies are sending us low-ball numbers to do these signings. Their justification is you only have to print one copy and the client signs a portion electronically. So you have less to print. Well the mileage didn’t go down! Printing is a negotiable price in the process. The time it takes to perform the print, review, travel, signing time drops by a few minutes, still in most cases have to scan and then drop. Still the same number of notarization’s to perform. We don’t see the CD in what 90% of these signings, but you will note, the fee title is giving for the service has not gone down. The signing service is taking a larger profit. Who out there can say our services are respected? Idiots grab these up as easy pease and take them. I counter at my normal fee, I respect my worth. Ever wonder how all these low-ball companies have the same pricing? Do they collude with help from the NNA on price gouging our services, they wouldn’t do that behind our backs would they? If we do collude by sticking to our price they point fingers at us. I might be wrong but we all went into business to make a profit. I know what my bottom line is, do you know yours.
If your county recorder accepts electronically signed documents for recording, it means very little if the state has RON or not. The venue on electronic documents is the county in which the notary is located
They need to eliminate that middleman and trim the fat. The signing companies!
We are here to prevent mortgage fraud, at least that is in this state. I honestly feel that the CD is the nuts and bolts of the entire loan process. It is everything tied to that loan. The rest is just the paperwork. If you electronically sign a CD without anyone present, notary, etc. who is to say that the document cannot be tampered with, and the electronic signature be used without your knowledge to finalize. I just see this as a way to perpetrate a mortgage fraud with less effort. There is nothing “computerized” that is not vulnerable to fraud. That’s just me!
