Entity as the signer

Texas here :cowboy_hat_face: I have a question. I have a commercial signing tomorrow and the signature block lists the name of the business (ex: “XYZ Company, LLC”}. Should it be signed as such or signed in the name of the person that is signing the documents? The confusion really came in, when I saw a marital affidavit, with the entities name on it. Of course the entity isn’t married!

I’ll hear back from the title company before the appointment tomorrow, but I want to know what experience anyone else may have had with that and how it worked.

I had one a few weeks ago and the signer insisted he always signs his personal name on those lines, so I went with it, because that was the first time I saw that.

2 things: Your signer is correct. The Title Co. isn’t paying attention.

@NotaryLadyBre Especially for these types of queries, you’ll be BEST SERVED by reaching out to your hiring entity/Title Company.

Submit your query in writing & request their Reply to be in writing as well.

In my direct experience with Commercial Signing Orders [SOs], the Title/Escrow Company [T/EC] will clearly delineate how the document package is to be executed within their SO.

In addition, the signature lines on the documents vary from page to page contingent upon the role that the signer is fulfilling for that segment of the documentation; i.e., sometimes as Individual, sometimes as Corporate Role, etc.

So, truly there should be no confusion.

Ergo, it’s possible the document preparer utilized a software “Plug & Chug” program for a Residential Refinance format instead of a Commercial format; however, I’d make no presumptions & simply take the action I suggested above to ensure you provide the T/EC with an accurately executed document package.

That’s exactly what I’ve done, reached out to my scheduler to confirm with the title company. I was just asking what others experience has been.
I’m not leaving anything to a guessing game, especially not with this many pages.
I’m on standby for their response. Best believe I will not be having those docs signed until I hear straight from the horses mouth.

Thank you, Arichter. He said he’s signed several before and always signed as himself on those lines that have the entity’s name. The docs were sent and everything was everything. The title company thanked me and gave drop approval. :wink:
That was definitely a learning experience.

Title just came back on this one this morning and said the same thing, for them to sign as themselves, not the entity, even though the signature block says “XYZ Co, LLC”

Ok, here we go. I see the response is showing your name now.
Just heard back from the scheduler. Title did state to sign just as my other client signed, as themselves, not the entity. Also, asked me to print something else they left off, that I questioned them about.

They said to have them fill out the marital affidavit as themselves, as well. Also asked me to print another copy, since there are 2 signers. Their error :upside_down_face:
