I assume I can use my new commission stamp on the day my current commission expires because my new one went into effect in March but the state office told me I can use the current one right up to it’s expiration date.
So when do you switch to your new stamp? Just curious.
In California, renewing notary commissions run concurrently. The new one goes into effect the day the old one expires. For instance, my commission expires Jan. 12 and my new commission starts Jan. 13. I start using my new commission/stamp Jan. 13, not earlier and destroy my old notary stamp at end of day Jan. 12.
A Commission and any associated Special Endorsement expires if not renewed by midnight at the conclusion of the date of expiration.
It’s clear I can use the old commission right up to the end of the day on the expiration date. But since the rules say the old commission expires if not renewed maybe that means that once I renew, my commission is continuous from the date I have my new commission in hand until the new expiration. So if I did a notarization on January 31, 2025, the last day of my old commission, maybe I should have written “My commission expires January 31, 2027” on my notarial certificate that day. I doubt we’ll ever find out for sure, because it just isn’t the sort of issue anyone would take to the Vermont Supreme Court to establish a precedent.
In actual fact, I didn’t have any notarizations in the period between when I renewed and when my old commission expired.
Adding practical consideration: Vermont does not require stamp vendors to check for proper documentation of the new commission, like California does. Even so, some vendors require Vermont notaries to send a copy of their commission before they will make a stamp. Last time, I received my new commission December 18, 2024 and the new commission commenced February 1, 2025. If I chose to have my expiration date in my stamp, I might have placed my order on December 19, and might have received the stamp around January 6. So if I did any notarizations December 18 through January 5, I would have had no choice but to use the stamp with the old date.
In fact, I don’t put my expiration date on the stamp; it isn’t required to be on the stamp. So I didn’t order a new stamp.
It actually expires on a Saturday and I rarely take appointments on a Saturday. Hey Fletcher - I said I was curious what other people do. Sometimes people just shouldn’t post. Just saying. Fight the urge. LOL. I have to a lot.
LOL! Stephen R. Covey noted that real listening isn’t done to respond, it’s to actually grasp what the speaker is saying. In this situation, I read to understand your post. I can’t come up with anything that disagrees with the response from your state office. So, are you expecting people convey something differently?
I do see, having an awesome week. I am sure that you are satisfied with your production for this week as well. It seems as like signing orders volume has increased and that’s good…
Have you found passages in the materials from your SOS, or the law or Washington Administrative Code, that make it clear to you
If you haven’t renewed, whether you can notarize on the date listed as your expiration date on your commission or bond?
If you have renewed and obtained a new bond, whether, when completing a notarial certificate, you may list the expiration date of the new commission during the time the old commission is still in force?
I called the office in Olympia and was told to use my current stamp until midnight 4/28/2025. It was one of those things bothering me. I renewed my E & O to start 4/28/2025 and that’s why I was thinking better use the new stamp. And the person at the office for WA State said - you can it won’t be a problem.
I encountered this. The expiration date on your stamp indicates the last day it can used. You will need to purchase a new stamp reflecting updated commission expiration date. If you have an embosser (subject to state regulations, so verify accordingly), you may use it. Ensure that you also have the ink stamp a gold seal for the imprint.
Oh I have my new stamps and bond and E & O. My new commission kicked in the day I paid for it. But the state office said I can use the old stamp until Midnight the day it expires. Our state got rid of the embossers.
