Mortgage Connect Signing Agent Errors and Omissions document

I will not be signing the poorly written and grossly weighted document below.

As written, this states that the Signing Agent is responsible for adjusting for any and all CLERICAL errors on the documents for a period of 6 months, with no definition of “clerical”.

This document also allows MC and or the lender to modify our notarial acts at their discretion.

No one arbitrarily alters my notarial acts - not when it is my name and my stamp on the line.

No Notary at Kidd Notary Services will be signing this document.

SIGNING AGENT ERROR AND OMISSIONS / COMPLIANCE AGREEMENT

The undersigned Signing Agent or Agents for and in consideration of the above-referenced Lender
funding the closing of this loan agrees, if requested by the Lender or Closing Agent for the Lender,
to fully cooperate and adjust for clerical errors, any or all loan closing documentation if deemed
necessary or desirable in the reasonable discretion of the Lender or Closing Agent.
The undersigned Signing Agent or Agents agree to comply with all above noted requests by
the above-referenced Lender/Closing Agent within 30 days from the date of mailing of said
requests. Signing Agent or Agents agree to assume all costs including, by way of illustration
and not limitation, actual expenses, legal fees and marketing losses for failing to comply with
correction requests in the above noted time period.
The undersigned Signing Agent or Agents further grant Mortgage Connect, LP as the settlement
agent or their designee and, or LENDERNAME as lender, authorization to correct all minor
typographical or clerical errors including initials and, or dates discovered in any or all of the
closing documentation required to be completed by the undersigned at settlement. In the event
this Agreement is exercised, the undersigned will be notified, and if requested by lender or
borrower, will receive a copy of the document corrected on their behalf.
This Agreement may not be used to modify any terms of the loan and, or security instrument.
This Agreement shall automatically terminate 180 days from the date of recording of the
undersigned’s mortgage loan.

I will probably have a conversation with them about it.

Their cover letter states in part:

" The Mortgage Connect closing packages will now include the Signing Agent Errors & Omissions document. The document will allow Mortgage Connect to make updates to documents (outside of the acknowledgment(s)). Notification will be sent to all notaries advising that a change was made based on this document rather than contacting you for permission. An example of the document is attached [here]." [emphasis is mine]

I may be wrong, but I read that “emphasized” portion as they won’t be altering the notarial certificate.

Now, if they would only spend as much time and energy in cleaning up their documents and their errors as they do in attempting to place blame elsewhere … Additionally, if they would just go back to paying professional fees … (I know, I know – singing to the choir )

Yes, as I said in the other thread, if they’re talking about the certs, it won’t fly in FL … Changes to the notarial cert are not allowed after the fact

“(8) A notary public may not amend a notarial certificate after the notarization is complete.”

Agree with LindaH-FL. Same in CA as in FL

As I said in other thread…nope newer notaries see this and heed the advice instead of just blindly signing because the company said so.

Also agree with @judikidd … very broad use of term “clerical”

Hi Judi ~ I agree with your statement. Since I already do not sign with Mortgage Connect due to their low ball offers shouldn’t be a problem. My gut guess is they are taking this stance since a lot of newbies accepting low ball offers are messing up. Interesting recent NAA broadcast questioning if notaries are setup to be professional notaries. Lot of newbies fell for sales hype and are now realizing what they signed up for.
