I’m notarizing a Florida document in Colorado. The instructions said I can be a witness and the spouse can be the other witness. Is this allowed?
Check your state notary laws; in Florida the notary can act as a notary AND a witness providing they are not named in the document or have a beneficial interest in the document.
Depending on the document, I’d be very leary of having the husband act as a witness - IMO he does have a vested interest in anything his wife does; But that said, I guess you just do what you’re told (providing your notary law allows it) - Who gave you the instructions?
The lawyer’s assistant in Florida.
Well, like I said, I’m leary of having a husband witness anything for a wife for the above reasons; but if that’s what you were told then just do it. As for you being a witness, make sure it’s not against your notary laws - if Colorado allows for the notary to also be a witness, you’re fine.
Good luck
Thanks, Linda. I decided to be safe and went to my bank where I used to work. We did the notarization there and I had two old coworkers be the witnesses. Thanks for your prompt reply and contribution.
Happy to hear it worked out for you. And good for you for having such good co-workers!!
Yes, I’m thankful for them.
