Partially blind client

Reverse Mortgage application signing. Great looking package; yellow blocks surrounding signing/date lines. This client could not sign in the box. I tried everything to help, everything, but we got through it. I felt complicit in manipulating this woman to sign the documents. I’m of the belief they can’t sign what they can’t see. She kept saying she needed glass, which she had but at 85 years old I believe it was more. Client did not have a driver’s license (as she couldn’t see to drive) but had a most recent state ID. It took 2 hours to sign and because each signature was such an issue it became very nerve wracking. Her sister was there for support, and I didn’t understand why she didn’t have a limited POA to sign the documents for her. Now Part 2: she lived about 1/2 mile off the hard surface road. Her trailer had been there since 2001. I’m willing to bet the road had not been maintained since 2001. I need to get something else signed but I refuse to go back to the house because of the road condition. (We are not paid for abnormal wear and tear on our vehicles) Please note: the craters in the road had potholes as well. I suggest her sister bring her 1 mile up the road to a church parking lot. It will take 1 minute to do what we need to do. Company is not responding, client is not responding. Something just doesn’t seem right.

I’m thinking, walk away. Shred the documents. What would you do?

Keep trying to get a response from both and document, document, document what’s happening. Also get one of those plastic thingys with a cutout for where the signature goes that you put on the paper as a visable & tactile guide.

If you have signed docs and only need one more signed, no you cannot shred those docs. Return them with a detailed note to whoever the circumstances. I’d also give hiring party/title a heads up of what happened. Let the company get that one doc completed. But, again, no you do not destroy the docs she already signed.

I signed seller docs with a 99 year old who was legally blind. Her son guided her pen to the spot and she signed from memory. Knew exactly what she was doing. And he had a PoA but she wanted to sign her own stuff. You can’t shred what is missing one document. And you must not be rural. I drive roads that aren’t paved all the time. You charge to ensure you have a repair fund.

I finally got in touch with the sister this morning! She completely understood my not wanting to drive the road again. She is going to get her sister this afternoon and meet me 2 miles from the house. I have documented, documented as you suggested. The title company finally contacted me this morning and the contact said she is going to see if underwriting will take this application as is. (One date was scribbled but initialed and another date that I thought was a date, was not.) If not, I will meet them today at 4:30. The sister has invited me to her house for any additional signatures.

Was DocUSign an option, I wonder? It’s only one document. Was it an application or actual loan docs?

That would be great but she doesn’t have cable, cell, computer, etc. and I couldn’t even get a signal. I have Starlink for the vehicle but I just bought a new SUV and we haven’t moved it over. (that’s going to happen real soon now) Procrastination…it can cost you! Note: I drove a 2024 4-wheel drive truck before trading in, and I wouldn’t have drove it down that road, it was that bad. (Gas mileage is horrible on the mid size trucks! My husband was getting 12-15 gallons more per gallon in his full size. I’m doing much better with my gas bill now!)

God Bless you. If I had had that signing I would have had to read every document to her…word for word. (that’s when I tell title/hiring party “get a POA in place…you don’t want to pay my fee for this”)

She knew exactly what she was signing had signed the same documents many times after selling a chunk of land to fund her home health care for the next year. I don’t read anyone anything word for word.

Well, when it’s the law, we have to follow it, whether we like it or not

I was doing a reverse mortgage one time when the lady was very nervous and her two grown kids were yelling at me just to complete the signing. The signer couldn’t ask my question what if she knew what she was signing. I told them to get a power of attorney. And that I would not be completing the signing. I called the title company and they were cool with that. I still got Full fee. Drop the mic.
