I have started seeing a lot of affidavits that say the signer has been duly sworn and on oath deposes, but the attached certificate is a general acknowledgment not a Jurat. Before the last several weeks the sworn affidavits have had Jurats attached. Anybody else seeing this change? What do you do when you see this? I have contacted Title recently with this issue and they wanted the acknowledgment left in place and used, but for me to add a Jurat as well. What do you do in a case like this? In Tennessee where I live any affidavit that contains an oath and sworn statement requires a Jurat or the oath cannot be administered.

I use whatever is in package. I have them take an oath the same as I always do. I honestly haven’t noticed that.
I have noticed it here in the last month or so. I have one today where they have several sworn statements with a general acknowledgment attached. While we can’t tell them what certificate is needed, as a courtesy, I notify title that per Tennessee law I cannot administer an oath and use a general acknowledgment. Here if an acknolwedgment is used in place of a Jurat it will nullify the sworn statement as it causes a legal mismatch.Today, they said no oath was needed (even though the document does say sworn on oath), so no Jurat is required. As long as the oath is not administered, an acknowledgment is acceptable.

I’ve seen documents that aren’t notarized that use that kind of language, too.
