Georgia closing done in Texas

I’ve been asked by a couple who live here in Texas to notarize their documents for a home they are buying in Georgia. They have the docs. I did a closing last year sometime for what I think was a home being bought in Georgia with the closing here, and I remember having to have an attorney on the phone while we did the closing. I asked the couple who contacted me about an attorney being on the phone during the closing,and they said no, that wasn’t necessary.

Is an attorney required to be on the phone in this situation? Thanks for your help!

Questions:

Are you just being asked to notarize, or are you being asked to conduct the entire signing.?

Where did they get the docs?

Read this from a law firm - it may or may not help - I, personally, would question it as, from MY understanding, GA is a really strict attorney-only state and there could be trouble down the line if the rules are bent or broken.

Thank you for the information, Linda. The attorney is the one who sent them the docs. I spoke to him and he said he did not need to be on the phone. Apparently he’s tabbed everything–where everyone signs and where to notarize and he says I just need to notarize the signatures. Okay then, that’s what I’ll do.

Yep…ya just do what you’re told. That’s all on him - I think I would have asked him for those instructions in writing to cover my own.

Never trust the signers to accurately answer legal questions. Always, as you did, contact the originating party as to what needs to be done.

The title company should have included instructions. Some states need attorneys, some not. I have closed quite a number of out of state sales and purchases without issue
