Ok MY STATE LAW ( this may not be true for your state ) says I cannot be a witness AND the notary that notarized the deed . So here we go ….
I received a signing this morning and the signing service calls me to tell me it requires 2 witnesses and if the signers can’t provide one to let them know so I can bring a witness and they can add the witness fee. This SS proceeds to tell me I can be one of the witnesses . Sigh. This is not ok in my state. I can do one or the other not both . I’m not mad It’s either they are not aware of my state laws or are trying to play me to get me to do it, I refuse to be the witness on these documents as I am the notary. Wish me luck on convincing the SS that I cannot be the witness and the notary.
Should be easy enough to convince the SS that your state does not allow you to be witness and notary for the same transaction. Send them a copy or excerpt of your state’s notary handbook where that regulation appears. That’s what I always do when something comes up about California notary law they’re not familiar with.
