Has anyone ever had this experience… The signers last name on her ID was her married name. On the documents was her maiden name. Mind you she has been married for 40 years. Is this normal for a SS/EO to request the signer cross out her maiden name and put her married name on the documents. I know this goes completely against what we learn with IDing people and the names matching the document.
If title is telling you this, get it in writing…if SS is saying this, question them again AND get it in writing.
I see a redraw on the horizon with an a/k/a.
To help us, where are you located?
That sounds peculiar. I agree if not a complete re-draw probably a Quit Claim and a new Deed to take care of the legal name issue with trailing documents. Even with Escrow requesting the name be corrected like that - they’ll have to do something about the Deed. Very strange.
@ErinD In my direct experience, I’ve seen scenarios like this when “She” was single when purchased the property and “took title” in the maiden name.
After marrying, the Title/Deed/Mortgage wasn’t updated - oftentimes the lender is reticent or indicates a Refinance will be required, which some resist due to a higher interest rate.
In this instance, I’d think that it would be the opportune time to revise the Deed & bring the documents Up-To-Date.
Usually, though you’ll see an Affidavit for Also Known As [AKA] or Formerly Known As [FKA] document within the document package.
It’s always best to bring this situation to the attention of the hiring entity for their determination regarding a resolution of the discrepancy.
Best Wishes!
Agree with all your comments but sounds like Title or someone in the processing group did not do their homework. Once upon a time ran into similar situation when woman remarried 5 times. Paperwork was all messed up with multiple names. Thankfully reviewed docs prior to signing and Title fixed docs and paid me extra fee to reprint.
Totally agree with you.
