I have a 7am purchase signing this coming Monday. I just finished prepping docs. For the first time ever, IME, the US Patriot Act ID form has the verifier signature line already filled out. It’s the electronic signature of the mortgage broker – no date, no title, just the electronic signature.
In the past I’ve run across where under the signature line I’ll find “settlement agent” and I’ve always been instructed to cross through and replace with my title and I’m to sign and date that form. On this form for Monday, only the broker’s electronic signature appears on the signature line, nothing below that line.
Has anyone else seen this and how did you proceed? Today is Saturday and title is closed. Guess I’m just gonna leave it as is.
Have never seen that. Think I’d wait ‘til Monday and check with Title before shipping. I do have an advantage as FedUPS never pick up over the weekend. Am kinda leaning to just adding my signature, title and date I verified. The broker has said that he verified, but, well, SO DID I!
Given that this is a US government document and the mortgage broker has already affixed their signature, my course of action would be to reach out to either the hiring company or the mortgage broker directly. I am hesitant to make any alterations or move forward with the form in its current state. It’s my understanding, based on my experience and understanding of the US Patriot Act requirements, that the individual who signs as the verifier is ultimately responsible for the accuracy and completion of the form. Therefore, I believe it’s best to seek clarification and guidance from the involved parties before proceeding.
Signing was this morning at 7:00am. Of course, there was no one available over the weekend to ask. I did, however, email the signing service (one that’s always been very responsive, very professional).
That US Patriot Act form is a 2-pager with first page having the signers’ info and 2nd page having the verifier’s info. Given this last piece, I made the executive decision to sign and enter my info as verifier. I did not cross through the broker’s electronic signature. Rather, I signed next to him. I figured if title/lender didn’t like my decision, they could always print that 2nd page and switch it out.
I finally heard from the signing service, who apologized for the late response. She asked what I’d done. I told her and after explaining my decision, she said “Perfect.” She’d never heard of/seen what I’d found.
Sometimes we just have to rely on our experience and that of others. Thank you all for your input.
