Signing services’ Contracts

Am I the only one that reads the provisions of signing services’ Terms of Use Agreements? I mean all the terms, not just the “when do I get paid” section. Have you declined to work with any of them because you don’t agree with their terms?

I read them all. To me, they’re all pretty standard. Some terms are surprising though. There is one company I can’t remember which one wink wink that says mentioning them by name in social media will result in a do not use listing and maybe even legal action.

Really? Standard? My contracts with my direct business partners don’t contain threats of blacklisting, restrictions on who I can do business with, undisclosed fee deductions.

This might be a fun game… name the most ridiculous condition you’ve seen in a SS terms & condition agreement? I’ll go. This business acknowledges you’re an independent contractor/business owner. However, while you work for them you agree to suspend your business policies and procedures and follow theirs instead. The next paragraph you agree to indemnify and hold them harmless from any liability or damages as a result of your services. Huh? Lol

What I mean by that is - they are all similar. Some folks say no way! For the most part I accept them. But the whole industry is about “hold me harmless it’s not my fault”. I am surprised anyone signs a mortgage.

I read them. What I don’t agree with, I simply cross out, initial and submit. Never had a push-back.

Nobody would ever do business with anyone if they took the fine print seriously. It’s just the risk that you take in doing business. We know it, the companies we work for know it, and the public at large knows it. Everything you do is a calculated risk. You just have to use good judgment and learn from experience the best way to go about your business.

Except that more and more of them are coming digitally through the platforms and you can’t retrieve the documents until you agree or decline (in full) the terms of their contract.

I don’t understand your response. What is the “risk that you take in doing business”? We, the companies and the public, know what?

Yes, that is what I do. Especially the companies who want you to agree to let them automatically assign signings to you and for you accept what they are willing to pay. No thank you. I prefer full control of my own appointment calendar and the ability to negotiate rates based on the amount of work expected.

I will not accept net 30 anymore, I had a SS cal me yesterday, offering 65 bucks for 3 hours of my time and I said i do not do net 30 an more, I cannot wait for a extra long return on my resources…

We are talking about documents that require the notary to fill out, sign, and return to the vendor management for that company. Very easy to do. No matter who is asking, I never accept loan assignments blindly; I never accept signing fees blindly. Companies are expecting/assuming most notaries will just agree to everything in their contract. If you sign up and can see the contract terms they are offering, if you don’t agree to what they are asking, mark it so, date/sign it, and send it back.
